Purpose

In particular, these updates serve to clarify the application of the conditions under which contracting officers must engage a Price Support Directorate advisor to mitigate risks associated with procurements where price is based on estimated or actual costs and to align with current pricing guidance and tools.

Effective date

PN-147 is effective immediately.

It is expected that the approach promoted by the updated Directive and associated Guideline will normalize the mandatory engagement of Price Support Directorate advisors for cost and price analysis services and increase awareness of best practices to support the price, assess the risk and increase the clarity, consistency and transparency of pricing decisions.

It is also expected that the effective management of pricing, and the use of pricing as an enabler to achieve better contractor performance, will result in the best value for Canada.

Background and context

As detailed in the Department’s response, an independent study dated December 2015 concluded that Canada’s pricing framework is sound but findings indicated that guidance material and tools were necessary to further foster transparency and consistency in pricing decisions.

The Directive and Guideline referred to in this PN represent measures to facilitate consistency and achieve fair value in cost-based pricing. More specifically in cases when only one compliant bid is received, or when the procurement is awarded on a non-competitive basis, or when following a competitive process, price negotiations with the successful bidder are required, the contracting officer must ensure that Canada obtains fair value with the support of cost and price analysis services.

Public Works and Government Services Canada (PWGSC) dedicates in-house Chartered Professional Accountants (CPAs) for the provision of financial expertise to assist Acquisitions Program (AP) contracting officers involved in identifying financial and pricing risks and determining the most suitable pricing approach of a procurement. This expertise, as part of the Price Support Directorate, includes price advisors and assurance advisors skilled in areas such as the development of pricing strategies, benchmarking tools, price and technical validation.

Requirements and responsibility

The Acquisitions Program contracting officer leads the development and progress of the procurement and is required to engage a Price Support Directorate advisor when a procurement presents specific risks.

The mandatory conditions as previously stated in the Directive and outlined in Section 6.10.10 of the Supply Manual have changed.

It is now mandatory to use the services of a Price Support Directorate advisor when the procurement presents any of the following characteristics:

  1. Any potential sole-source procurement with a total estimated value of $1,000,000 or more, including applicable taxes, options and amendments.
  2. Any competitive procurement with a total estimated value of $1,000,000 or more, including applicable taxes and options, where only one compliant bid is received.
  3. Any competitive procurement with a total estimated value of $1,000,000 or more, including applicable taxes, with contract provisions for negotiated prices or where prices are likely to be negotiated as a result of a contract amendment.
  4. Any competitive procurement, with a total estimated value of $10,000,000 or more, including applicable taxes, options and amendments.

Early engagement of Price Support Directorate advisors

Price Support Directorate advisors should be engaged at the planning phase of a procurement, when pricing approaches are assessed to determine how a contractor will be compensated to enable the achievement of a procurement’s objective, in a way that delivers value to Canada.

In order to efficiently manage pricing throughout the acquisition lifecycle, the contracting officer must request the assistance of advisors from the Price Support Directorate as soon as it is known that the above mandatory conditions apply and as often as necessary depending on the complexity and pricing risks of the procurement.
