1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.

2. Definition of requirement
Public Works and Government Services Canada on behalf of
Environment Canada - Climate Research Division - Atmospheric
Science and Technology Directorate has a requirement for the
supply and delivery of one (1) complete Aerosol Chemical
Speciation Monitor (ACSM) instrument system as specified under
"background" below.  The purpose of this Advance Contract Award
Notice (ACAN) is to signal the government's intention to award a
contract for these services to Aerodyne Research Inc, Billerica,
Massachusetts, USA. Before awarding a contract, however, the
government would like to provide other suppliers with the
opportunity to demonstrate that they are capable of satisfying
the requirements set out in this Notice, by submitting a
statement of capabilities during the 15 calendar day posting
period.  If no supplier submits a statement of capabilities that
meets the requirements set out in the ACAN, on or before the
closing date stated in the ACAN, the contracting officer may
then proceed with the award to the pre-identified supplier.

Background

The Aerosol Chemical Speciation Monitor (ACSM)  from Aerodyne
Research Inc., is a unique technology solution that is able to
have simultaneous measurement ability of the mass concentration
for Sulphate, Nitrate and Organic Component species. The ACSM is
the only known solution that can measure particle sizes between
0.1 micrometre and 0.6 micrometre in diameter for each of the
aforementioned species. No other solution offers the detection
sensity limits based on a 30 minute or less sample size, offer a
sample average time of 1 to 5 minutes, processing software that
offers data acquisition, time stamp of mass concentration
samples and quantitative conversion of spectra to mass
concentrations. The ACSM instrument also has remote operation
via long distance communication. 

It is necessary to retain high quality airborne instrumentation
for measurements of major chemical species in the fine particle
aerosol (sulphate, nitrate and organics). EC will use the data
collected to contribute to Canada's knowledge of chemical
changes in aerosol particles over time and their interaction
with climate. EC requries the ACSM of the highest quality to
augment its critical understanding of the influence of man-made
and natural particles on climate change. 

Without having the ability to detect sufficiently low detection
limits, EC cannot evaluate the chemical components that help us
identify not ony the level of the baseline aerosol but, also
potential sources and how they change with time. 

The instrument will be located in Alert, Nunavut, which is
several thousand kilometres from the base operation of the unit
in Toronto. Therefore, it is necessary for the instrument to be
controlled remotely from Toronto to address any issues that may
arise. The contractor must provide and complete all aspects of
delivery by March 31, 2015, including delivery, transport,
set-up and installation.




3. Criteria for assessment of the Statement of Capabilities
Minimum Essential Requirements

Any interested supplier must demonstrate by way of statement of
capabilities that it meets the following requirements:

Aerosol Chemical Speciation Monitor (ACSM)

Deliverable: The Aerosol Chemical Speciation Monitor must meet
or exceed each of the specifications outlined below.

1.1	The ACSM must have simultaneous measurement ability of the
mass concentrations for  each of 		the chemical species (a), (b)
and (c) identified below:

	(a)	Total Sulphate
	(b)	Total Nitrate
	(c)	Total of organic components

1.2	For each of the chemical species identified under (a), (b)
and (c) the ACSM must measure 		particles in sizes between 0.1
micrometre and 0.6 micrometre in diameter as a minimum. 

	-	Total sulphate
	-	Total nitrate
	-	Total of organic components.

1.3	The ACSM must have detection sensitivity limits of Mass
Concentration  within the specified 		ranges for each of the
chemical species identified below under (a), (b) and (c) based
on a sample 		averaged over 30 minutes or less.  

	Chemical	Mass concentration ( g m-3)
	Total Sulphate	0.03
	Total Nitrate	0.03
	Total Organics	0.3
 	
1.4	The ACSM must have a Single sample averaging time of 5
minutes or less. 

1.5	The ACSM  system must have Windows-7 compatible software for
processing that must provide 		each of the following features: 

	(a)	Data acquisition 
	(b)	Processing to produce time stamped mass concentrations of
nitrate, sulphate and total 			organics for each sample average.
	(c)	Quantitative conversion of spectra to mass concentrations 

1.6.	The complete ACSM instrument must sit on a standard lab
bench top within a space of 60 cm 		wide. 

1.7	The complete ACSM  instrument must be no higher than 1.5
metres.

1.8	The weight of the ACSM must be equal to 90 kilograms (kg) or
less.

1.9	The ACSM power requirement must be limited to 500 Watts and
have a standard operating 		voltage of 110-120 VAC. Must conform
to CSA standards.



4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements:
Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)
World Trade Organization - Agreement on Government Procurement
(WTO-AGP)

5. Justification for the Pre-Identified Supplier 
Aerodyne Research Inc., is the only known commercial
organization available solution capable of providing a ACSM with
the ability to complete all of the associated deliverables
stated under Section 3 - Statement of Capabilities, and by the
delivery date specified above.

6. Government Contracts Regulations Exception:
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - only one
person is capable of performing the work.

7. Exclusions and/or Limited Tendering Reasons 
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:

Agreement on Internal Trade (AIT) Article 506.12b) Where only
one supplier is able to meet the requirements of a procurement,
an entity may use procurement procedures that are different from
those described in paragraphs 1 through 10 in the following
circumstances:
	
(b) where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists;

North American Free Trade Agreement (NAFTA) Article 1016: 
Limited Tendering Procedures.	 An entity may use limited
tendering procedures in the following circumstances and subject
to the following conditions, as applicable: 
	
(b) where, for works of art, or for reasons connected with the
protection of patents, 	copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;

World Trade Organization - Agreement on Government Procurement
(WTO-AGP) Article XV 
Limited Tendering Procedures.	 An entity may use limited
tendering procedures in the following circumstances and subject
to the following conditions, as applicable:

(b) when, for works of art or for reasons connected with
protection of exclusive rights, such as patents or copyrights,
or in the absence of competition for technical reasons, the
products or services can be supplied only by a particluar
supplier and no reasonable-alternative or subsitute exists.

8. The period of the proposed contract or the delivery date(s) 
The products must be delivered on or before March 31, 2015.

The period of the contract is from date of contract award to
March 31, 2015.

9. A cost estimate of the proposed contract. 
The estimated value of the contract is $232,000.00 USD
(Applicable Taxes extra).

before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.

12. The closing date for a submission of a statement of
capabilities. 
The closing date and time for accepting statements of
capabilities is December 29, 2014 at 2:00 p.m. EDT.
