1. Advance Contract Award Notice (ACAN)
 
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 


2. Definition of the requirement 

The Department of National Defence has a requirement for the rental and training of one (1) remote controlled slope grass cutter, for the bomb dump area at CFB Trenton, Ontario. The work will involve the following:

a. Supply one (1)  unit during the grass cutting season, usually a five (5) month period (May to September);
b. Provide factory training for four (4) in house employees; and
c. Perform all maintenance (including inspections every 6 weeks, oil changes and filter changes).

The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to J&S Performance and Distribution Ltd. (Niagara on the Lake, ON). Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the fifteen (15) calendar day posting period.  If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
 

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 

Any interested supplier must demonstrate by way of a statement of capabilities that its product/equipment/system (as appropriate) meets the following requirements: 

a. Ability to provide factory training to four (4) operators at the beginning of each grass cutting season.
b. Ability to perform all maintenance of the mower, including but not limited to six (6) week inspections, oil changes and filter changes.
c. Approval for radio frequency usage in the ammo storage area, as per HERO assessment guidelines.
d. The mower must contain a handheld transmitter, approved for use in Canada for operating at certain frequencies in the range of 430.100 MHz to 477.000 MHz, at a maximum power of 0.025 W. In addition, the mower must have electronic ignition, an electronic starter, and a cutting blade with an electromagnetic brake/clutch, which may produce unintentional electromagnetic (EM) radiated emissions.


4. Applicability of the trade agreement(s) to the procurement

This procurement is subject to the following trade agreement: 
Canadian Free Trade Agreement (CFTA)


5. Justification for the Pre-Identified Supplier 

The Dvorak - svahove sekacky Ltd. has the patent for the radio controlled Spider slope mower. J&S Performance and Distribution Ltd. is the exclusive Dvorak’s distributor for all of Canada. Spider remote control slope mowers are meant for cutting in dangerous areas, on extreme slopes and banks, and in areas plagued with invasive plant species. J&S Performance and Distribution Ltd. is the only known commercial organization with the ability to complete all of the associated deliverables.


6. Government Contracts Regulations Exception(s)
 
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.

 
7. Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement specified: 

Canadian Free Trade Agreement (CFTA) - Article 513, (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (iii) due to an absence of competition for technical reasons.


8. Period of the proposed contract or delivery date 

The proposed contract is for a period of two (2) years, with the option to extend the term of the contract by up to two (2) additional one (1) year periods.


9. Cost estimate of the proposed contract
 
The estimated value of the contract, including options, is $94,468.00 (HSTI).

Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.


12. Closing date for a submission of a statement of capabilities

The closing date and time for accepting statements of capabilities is September 9, 2020 at 2:00 p.m. EST.
