Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of Public Works and Government Services Canada, Parliamentary Precinct Branch has a requirement to develop a Building Information Modeling (BIM) and Energy Performance modeling exercise to create an interactive 3D-model of East Block for the purposes of the upcoming rehabilitation project of the building. The BIM model will be provided to the Projects Consultant and ConstructionManager upon Contract Award. The work will involve the following: A. Prepare East Block specific BIM requirements and data sharing protocols for design consultant and construction manager use; B. Advance the research and understanding of the structure, heritage elements, and energy performance of East Block, and its surrounding site; C. Develop a baseline BIM and energy performance model built on the research outlined above; D. Document the rehabilitation of heritage elements within the interior and exterior envelope of East Block, and the surrounding site; E. Collaborate with other Universities and/or like institutions, providing an occasion to: share heritage conservation expertise within the mandate of the partner organizations; strengthen the training of future conservation practitioners in the use of new and emerging digital technologies used in heritage conservation and architectural rehabilitation; and, to advance the heritage conservation practice. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: A. Experience in developing BIM for interior and exterior of designatedHeritage Buildings while capturing, portions of the building, at a Level of Detail of Component Grade 3; B. Capabilities and experience with performing terrestrial laser scanning, photogrammetric, digital technologies and record photography; C. Extensive investigation and representation research capabilities, including: Deep Computing Visualization and rendering clusters; Immersive Environments (IE) technologies; broadband network technologies; and the customization and development of new media tools,middleware, and devices of design with industry and institutional partners; and D. The capability to perform extensive on-site work within the National Capital Region upon the specified contract award date. 4. Applicability of the trade agreement(s)to the procurement This requirement is considered Research and Development so this procurement is subject to the following trade agreement: o Agreement on Internal Trade (AIT) 5. Justification for the Pre-Identified Supplier Carleton Immersive Media Studio (CIMS) is a Carleton University research centre dedicated to the advanced study of innovative, hybrid forms of representation that can both reveal the invisible measures of architecture and animate the visible world of construction. CIMS hasbeenpre-identified as the only know supplier capable to perform the work for the following reasons: A. CIMS has been International renowned for their experience with the development of BIM for heritage buildings. B. CIMS has the capabilities and theexperience with performing terrestrial laser scanning, photogrammetric and, digital and record photography; C. CIMS is the only known supplier to perform research with the application of new digital technologies for the documentation, performance, and rehabilitation of architectural heritage; and D. CIMS is readily available to perform the required services in the National Capital Region. Being a non for profit organization it is expected that CIMS will provide good value for this work. The information collected to perform the work for this contract would provide an apparent unfair advantage to the contractor and will preclude the contractor from participating in the solicitation process for Architectural and Engineering Services and Construction Management Services for East Block rehabilitation. CIMS is not a potential supplier for other East Block Rehabilitation requirements and therefore will avoid situation of apparent unfair advantage or conflict of interest on other contracts. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work" 7. Exclusions and/or LimitedTendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: o Agreement on Internal Trade (AIT) Article(s) 506.12 (b) & (h) 8. Ownership of Intellectual Property Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the basis that the main purpose of the contract is to support the Prime Consultant and Construction Manager with their work related to the East Block rehabilitation. The modelisintended to be used as an asset-management tool once the rehabilitation of the building is complete. 9. Period of the proposed contract or delivery date The duration of this contract is for five years. The contract is intended to commence inMay,2017. 10. Cost estimate of the proposed contract The estimated value of the contract, including option(s), is $700,000 (applicable taxes excluded). 11. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 13. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is May 15, 2017, 04:00pm EDT. 14. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
