Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

Definition of the requirement

The Department of Indigenous Services Canada has a requirement for professional indigenous translation services on an as and when requested basis for the Communications Branch in support of response to emergency situations or urgent needs such as in cases of pandemic, business continuity operations, crisis communications.

  1. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    • A minimum of 10 years of experience providing professional indigenous translation services to public and/or private sectors.
    • Knowledge and understanding of style standards and terminology in use within the Government of Canada, including the departments of Indigenous Services Canada and Crown-Indigenous Relations and Northern Affairs (previously Indigenous Northern Affairs Canada)

This procurement is subject to the following trade agreement(s):

Justification for the Pre-Identified Supplier

After soliciting two different companies for proposal and doing researches on the Internet to find others, Wintranslation was the only supplier found who confirmed their capability to meet the department’s requirement.

Government Contracts Regulations Exception(s)

The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection:

subsection 6(d) - "only one person is capable of performing the work".

Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are invoked under the:

Canadian Free Trade Agreement (CFTA) – Article 513, 1. b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: iii) due to an absence of competition for technical reasons.

Ownership of Intellectual Property

Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

Period of the proposed contract

The period of the proposed Contract will be from date of Contract to March 31, 2021 inclusively.

Cost estimate of the proposed contract

The estimated value of the contract is not to exceed $80,000 including professional fees, travel and living expenses and applicable taxes.

Suppliers' right to submit a statement of capabilities

Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

Closing date for a submission of a statement of capabilities

The closing date and time for accepting statements of capabilities is September 2nd, 2020 @ 2:00 p.m. Eastern Standard Time.
