Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 


The Royal Canadian Mounted Police (RCMP), “Combined Forces Special Enforcement Unit”, British Columbia (CFSEU), has a requirement for a Contractor to disseminate anti-gang public service announcement posters within bars, pubs, and nightclubs located in as many communities as possible in the province of British Columbia.
The RCMP will be responsible to develop, create, and provide the posters to the supplier.
The work will involve the following:  

•	in collaboration with the RCMP Project Manager, strategically place posters in “Restobar” frames within captive environments in licensed bars/pubs and nightclubs in locations in British Columbia

•	collaborate with the RCMP on the geographic locations/markets for the posters (e.g. which communities will get which poster and in what concentrations);

•	recognize that all rights to the created content (posters) remain the property of the RCMP in perpetuity;

•	maintain and keep updated the “Restobar” display frames and absolve the RCMP from any liability or responsibilities related to any maintenance or upkeep;

•	collaborate with the RCMP regarding the replacement of posters when and as necessary based on the timelines of the campaign at the direction of the RCMP Project Authority;

•	ensure the confidentiality of any protected information

•	retain and obtain underlying rights to display space and provide documented proof thereof (releases) as requested by the RCMP Project Manager

•	manage the project and work collaboratively with the RCMP Project Manager

•	provide the staff or the means to transport the posters to their display locations and the staff or the means to insert the posters into the display frames.


The RCMP’s mandate is to target, investigate, prosecute, disrupt and dismantle the organized crime groups and individuals who pose the highest risk to public safety due to their involvement in gang violence.
This campaign will be the largest and most comprehensive anti-gang media campaign in British Columbia’s history, which is part of the RCMP’s mandate and the Province of B.C.’s anti-gang strategy.  This is an approximate 20 month campaign which will focus on education, prevention, intervention, and enforcement themes.  

Criteria for Assessment of the Statement of Capabilities (Minimum Essential Requirements):

Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the following requirements:

•	must have the ability to provide for advertising space in the majority of age 19+ bar, pub, and nightclub Liquor-Primary licensed establishments in British Columbia

•	must have dominant market share versus competitors in licensed (age 19+) bar, pub, and nightclub Liquor-Primary licensed establishments in all four provincial RCMP Districts - Lower Mainland (inclusive of all Metro Vancouver municipalities), Vancouver Island (inclusive of major Vancouver Island communities), Southeast (inclusive of main Thompson, Okanagan, Similkameen, Kootenay-Boundary municipalities), and North (inclusive of main Cariboo, Chilcotin, Peace River, and Northwest B.C. communities)

•	must be able to prove that they have the exclusive advertising rights to the advertising space within the above mentioned Liquor-Primary licensed establishments and prove that those rights are and will be retained for the duration of the contract

Applicability of the Trade Agreement to the Procurement:
This procurement is subject to the following trade agreements:

North American Free Trade Agreement (NAFTA)

Justification for the Pre-Selected Supplier:
The current supplier has exclusive ownership of the space that the RCMP is seeking, which is advertising space in the majority of age 19+ bar, pub, and nightclub Liquor-Primary licensed establishments in British Columbia

Government Contracts Regulations Exception:

The following exception to the Government Contracts Regulations is invoked for the procurement under subsection Section 6, (d) only one firm is capable of performing the work, of the Government Contracts Regulations set aside the requirement to solicit bids.

Period of the Proposed Contract:

The proposed contract is from April 14, 2014 to December 19, 2015

Cost Estimate of the Proposed Contract:

The estimated value of the contract is $83,000.00.  (GST is extra)

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
