Remarks – Recommended Use of SACC Item

Use the following clause in the resulting contract of standing offers when Canada will be responsible for the cost of surcharges applied by the carrier for the shipping of large, bulky or heavy items.

Insert this clause in Part 6B - Resulting Contract Clauses, of the 2T-RFSO1 template.

Use this clause in conjunction with D4002C.

Legal text for SACC item

Subject to the following paragraph, Canada will be responsible for the cost of surcharges applied by the carrier for the shipping of individual items weighing more than 30 kilograms or measuring more than 150 centimeters, including packaging.

Before shipping an order, the Contractor must notify the Identified User in writing of the cost of any applicable surcharge. The Contractor must, if requested, provide supporting documentation to the Identified User. The Identified User may, within 24 hours of written notification of the surcharge, cancel its order in whole or in part at no additional cost to Canada by giving written notice to the Contractor. If the Contractor does not notify the Identified User as required in this clause, the Contractor will remain responsible for the cost of the surcharge.
